Litigation Intelligence

The development of sound intelligence can be the keystone of any successful litigation.  Such intelligence can take many forms - developing litigant’s backgrounds, vetting witnesses and experts, evaluating litigation histories for factual evidence and strategy, and vetting the factual basis of a claim - all of which can make the difference between winning and losing.  The ability to develop factual, sound intelligence early on in a litigation setting provides the user with a distinct advantage in managing and ultimately resolving the issue at hand.

The Intelligence Group utilizes state-of-the-art investigative research techniques and methodologies to identify and develop crucial intelligence. Our experience runs the gamut from simple to complex, ranging from the identification and retrieval of public documents such as court records to the evaluation and reconstruction of complex corporate transaction histories:

§         In one such matter, we developed a plaintiff’s history of similar litigation strategy that proved invaluable to the successful defense of a claim brought against a large technology company.

§         In another matter, we evaluated the corporate viabilities of a group of co-defendants named in a historical environmental liability matter.  By tracing a series of complex corporate transactions, we were able to identify an ultimate corporate successor as the actual plaintiff in the matter. 

§         In other matters, we have developed historical information regarding opposing litigants in court records, media or other sources that have helped vet the factual basis of claims made and allowed for successful withdrawal or prosecution in countless matters.

Additionally, clients often ask us to develop evidence in a pre-litigation setting, including profiling of businesses and individuals, developing operational histories and assessing financial viability.
